UCI Law welcomes Davina Cooper, Research Professor in Law & Political Theory at King's College London, to discuss, "Should the Law Recognize Multiple Genders or None? Exploring the Stakes and Challenges in Radically Reforming Sex/Gender Classification."

This talk explores how the law should respond to gender identity. In many countries, governments and laws are making gender-transitioning easier or recognizing new gender identities such as nonbinary. Is this the right approach or would it be better if the law stopped registering gender and sex altogether? Can law do this, and still address gender-related inequalities and other forms of injustice?

Through four years of extensive funded research, the Future of Legal Gender Project explored the implications of abolishing legal sex and gender status in Britain. This talk explores the findings and conclusions of the project (read the final report here). It traces arguments made by those opposed to reform, explores other ways of understanding these arguments - to see them as prompts for more radical change rather than obstacles - and considers the value of 'slow law'. 

Davina Cooper who led this research project is a Research Professor in Law & Political Theory at King's College London. Professor Cooper is an interdisciplinary law and society scholar whose work focuses on radical governance, utopian practices, sexual politics and new conceptual methods. She is the author of 6 books including Feeling Like a State and Everyday Utopias (Duke UP) and Challenging Diversity (CUP). She directed the AHRC Research Centre for Law, Gender & Sexuality, and has been a local magistrate and a local politician in London, where she played a prominent role in the 1980s development of British lesbian and gay equality initiatives.

About the Book

Recent years have seen out-of-control wildfires rage across remote Brazilian rainforests, densely populated California coastlines, and major cities in Australia. What connects these separate events is more than immediate devastation and human loss of life. In Global Burning, Eve Darian-Smith contends that using fire as a symbolic and literal thread connecting different places around the world allows us to better understand the parallel, and related, trends of the growth of authoritarian politics and climate crises and their interconnected global consequences.

Darian-Smith looks deeply into each of these three cases of catastrophic wildfires and finds key similarities in all of them. As political leaders and big business work together in the pursuit of profits and power, anti-environmentalism has become an essential political tool enabling the rise of extreme right governments and energizing their populist supporters. These are the governments that deny climate science, reject environmental protection laws, and foster exclusionary worldviews that exacerbate climate injustice.

The fires in Australia, Brazil and the United States demand acknowledgment of the global systems of inequality that undergird them, connecting the political erosion of liberal democracy with the corrosion of the environment. Darian-Smith argues that these wildfires are closely linked through capitalism, colonialism, industrialization, and resource extraction. In thinking through wildfires as environmental and political phenomenon, Global Burning challenges readers to confront the interlocking powers that are ensuring our future ecological collapse.

Eve Darian-Smith is Chair of the Department of Global and International Studies, Professor of Global Studies, and affiliated faculty in Law; Anthropology; and Criminology, Law & Society at UCI. Trained as a lawyer, historian and anthropologist, Darian-Smith is a critical interdisciplinary scholar interested in issues of postcolonialism, human rights, legal pluralism, and sociolegal theory. Her current work focuses on authoritarianism and crises of democracy. Her research has been supported by five grants from the National Science Foundation, as well as grants from the Wenner-Gren Foundation, American Philosophical Society, and the UC Center for New Racial Studies.

Darian-Smith has published widely, including thirteen books, edited volumes and special issues. Her first book, Bridging Divides: The Channel Tunnel and English Legal Identity in the New Europe (2009) was the co-winner of the Law & Society Association Herbert Jacob Book Prize. Her book, Laws and Societies in Global Contexts (2013) won the International Book Award in Law and the Kevin Boyle Book Award. Her  book, coauthored with Philip McCarty, The Global Turn: Theories, Research Designs, and Methods for Global Studies (2017), is widely considered a foundational text in the emerging field of global studies.

Long Bui, Associate Professor of Global and International Studies at the UCI School of Social Sciences, will be presenting his book, "Model Machines: A History of the Asian as Automaton" (Temple University Press, April 2022).

About the Book:

How have Asians and Asian Americans been treated as non-human or less than human (subhuman) cyborgs throughout history?  The modern colonial idea that Asians behave, think, and act like robotic machines in the West has been used to justify all types of human rights abuses. As things or objects, they have been subjected to indentured servitude, forced prostitution, and concentration camps. Under this globally circulating stereotype, we find strange sociolegal issues of labor, criminality, disability, and citizenship around those not seen as Homo sapien but as human automatons. The author presents some case studies around this matter.

About the Author:

Long T. Bui is Associate Professor of Global and International at University of California, Irvine. His second book, Model Machines: A History of the Asian as Automaton is forthcoming with Temple University Press in June 2022.

Philadelphia's Eastern State Penitentiary and the Origins of America's Modern Penal System, 1829–1913 
(Cambridge 2021).

Abstract:
Early nineteenth-century American prisons followed one of two dominant models: the Auburn System, in which prisoners performed factory-style labor by day and were placed in solitary confinement at night, and the Pennsylvania System, where prisoners faced 24-hour solitary confinement for the duration of their sentences. By the close of the Civil War, the majority of prisons in the United States had adopted the Auburn System—the only exception was Philadelphia's Eastern State Penitentiary, making it the subject of much criticism and a fascinating outlier. Using the Eastern State Penitentiary as a case study, The Deviant Prison brings to light anxieties and other challenges of nineteenth-century prison administration that helped embed our prison system as we know it today. Drawing on organizational theory and providing a rich account of prison life, the institution, and key actors, The Deviant Prison examines why Eastern's administrators clung to what was increasingly viewed as an outdated and inhuman model of prison—and what their commitment tells us about penal reform in an era when prisons were still new and carefully scrutinized.

About the Author:
Ashley Rubin is an assistant professor of Sociology at University of Hawai‘i at Mānoa. She holds a PhD in Jurisprudence and Social Policy. Rubin's research examines the dynamics of penal change throughout US history. In particular, she uses organizational theory, law and society, punishment and society, and prison sociology to understand prisoner behavior, administrative behavior, and penal trends more broadly. In addition to her books The Deviant Prison and Rocking Qualitative Social Science, she is currently writing a book on the history of American prisons.

Hadar Aviram, Professor of Law at UC Hastings Law, will present a book talk titled Yesterday's Monsters: The Manson Family Cases and the Illusion of Parole on January 4th, 2021 from 2:00 to 3:30 p.m. via Zoom.

ABSTRACT:
In 1969, the world was shocked by a series of murders committed by Charles Manson and his “family” of followers. Although the defendants were sentenced to death in 1971, their sentences were commuted to life with parole in 1972; since 1978, they have been regularly attending parole hearings. Today all of the living defendants remain behind bars. Relying on nearly fifty years of parole hearing transcripts, as well as interviews and archival materials, Hadar Aviram invites readers into the opaque world of the California parole process—a realm of almost unfettered administrative discretion, prison programming inadequacies, high-pitched emotions, and political pressures. Yesterday’s Monsters offers a fresh longitudinal perspective on extreme punishment.

BIO:
Professor Hadar Aviram (UC Hastings) specializes in criminal justice, civil rights, law and politics, and social movements, and her research employs socio-legal perspectives and methodologies. Her first book Cheap on Crime: Recession-Era Politics and the Transformation of American Punishment (UC Press, 2015, winner of the CHOICE Award for Academic Titles) analyzed the impact of the financial crisis on the American correctional landscape. Her most recent book Yesterday’s Monsters: The Manson Family Cases and the Illusion of Parole (UC Press, 2020) examines the California parole process through 50 years of parole transcripts in the Manson Family cases. She served as the President of the Western Society of Criminology and on the Board of Trustees of the Law and Society Association, and is currently the Book Review Editor of the Law & Society Review.

Book Talk: Returns of War: South Vietnam and the Price of Refugee Memory (NYU Press, 2019)

Abstract:
In 1975, South Vietnam fell to communism, marking a stunning conclusion to the Vietnam War. Though this former ally of the United States has vanished from the present world map, Long T. Bui maintains that its memory endures for the country’s refugees. This attachment demands a deeper engagement with the law of war and the unique ways it works for countries in the Global South. Returns of War considers argues that the end of South Vietnam signals more than an example of flawed American military strategy and policy (Vietnamization), but a larger allegory of imperial power.

Erin L. Thompson, Associate Professor of Art Crime at New York's John Jay College of Criminal Justice, recently curated an exhibit of art by Guantánamo Bay detainees, most of whom have never faced trial or even had charges filed against them. Their artworks have been among the only ways detainees could communicate with the outside world - until the Pentagon declared it would no longer allow detainee-made art to leave Guantánamo.

Professor Thompson will discuss the exhibit and its consequences, her work with former detainees, and the unlikely ways their paintings of the sea reopened the debate on the future of Guantánamo. She will analyze the basis for the Pentagon's disputed claim that detainee- produced artworks are government property, possible ways to preserve detainee art, and the government's response to a filing seeking the release of detainee art (citing a Japanese internment case as precedent for government freedom to conduct war by any means necessary).

Professor Thompson received her JD from Columbia Law School, Certificate in Global Business Law from the Sorbonne, both a PhD and MPhil in Art History from Columbia, and BA in Art History and Philosophy from Barnard. Her recent book, Possession: The Curious HIstory of Private Collectors, covers the history of private collecting of Greek and Roman antiquities. She is currently researching the ways in which terrorist groups both sell and destroy art to support the genocidal campaigns, as well as the legalities and ethics of digital reproductions of cultural heritage.

The UCI Center in Law, Society, and Culture is pleased to support this presentation of the Anti- Imperialism & (En)gendering Resistance in the Philippines lecture series, featuring Dr. Catherine Ceniza Choy (UC Berkeley).

What would happen if we placed the lives of Filipino women at the center of a transnational narrative about U.S. and Philippine histories? This talk explores the connections and divergences among three Filipino women Encarnacion Alzona, Ines Cayaban, and Pacita Abad who migrated to the United States at different times during the twentieth century, led singular careers in education, public health, and visual art, and left documentation of their lives and work for posterity. In doing so, they reveal the opportunities, but also constraints of the legacy of the U.S. colonial presence in the Philippines.
